Restraining order against Halle Berry ends amid custody battle with ex-husband

Correction: The previous story erroneously noted that Halle Berry had lost custody of her son.

A judge has terminated a temporary restraining order against actress Halle Berry that was sought by her former husband, Olivier Martinez, as a custody battle over their 13-year-old son, Maceo, continues.

Los Angeles Superior Court Judge Shelley L. Kaufman dissolved the temporary domestic violence restraining order that Martinez had sought to make permanent.

Martinez, 60, is seeking full custody of their son, replacing the former couple’s 50-50 custody arrangement. He is also seeking to prevent Berry from having overnight visits with Maceo.

Martinez alleged that Maceo sent him text messages saying Berry abused him while he was playing a virtual reality game and that she had previously been hostile toward him. Berry has denied the allegations.

“I have never physically, emotionally or otherwise abused Maceo,” Berry, also 60, said in court papers. “I am a victim of domestic violence and I help victims of domestic violence. I am not a perpetrator of violence. I would never hurt our child.”

Berry and Martinez’s divorce was finalized in 2023 after an eight-year legal battle.
